Arkansas Law CONCERNING MISUSE OF TELEPHONE Act 107 OF 1963 Leg.

AN ACT to prohibit use of telephone facilities or equipment to annoy, abuse, torment, harass or embarrass others, or for any obscene, lewd, lascivious, filthy or indecent statement, to provide penalties for Violation of this act; and for other purposes. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: SECTION 1. IT SHALL be unlawful for any person to make use of telephone facilities or equipment (1) for an anonymous call or calls if in a manner reasonably to be expected to annoy, abuse, torment, harass or embarrass one or more persons, or (2) for repeated calls, if such calls are not for a lawful business purpose but are made with intent to abuse, torment, harass or embarrass one or more persons, or (3) for any comment, request, suggestion or proposal which is obscene, lewd, lascivious, filthy or indecent. SECTION 2. Any person Violating any of the provisions of Section 1 of this Act shall be guilty of a misdemeanor, and upon conviction thereof shall be subject to a fine of not more than one thousand dollars ($1000) or to imprisonment for not more than one year or both. APPROVED: February 28, 1963 Your local exchange and long-distance service cannot be disconnected or interrupted as a result of your failure to pay charges for interstate pay-per-call service, charges for interstate information services provided pursuant to a presubscription or comparable arrangement, or charges you have disputed for interstate tariffed collect information services. You can obtain blocking of access to services offered on the 900 service access code where it is technically feasible. You have a right not to be billed for pay-per-call services not offered in compliance with Federal laws and regulations established under Titles II or III of the Telephone Disclosure and Dispute Resolution Act. Your access to 900 services may be involuntarily blocked for failure to pay legitimate pay-per-call charges. EQUAL ACCESS Equal access is a service that allows you to use the long-distance company of your choice with ease of (1+) or (0+) dialing. Equal access is available to all Madison County Telephone Company customers. Not all long-distance companies will choose to provide this service to our area. Recently the Federal Communications Commission (FCC) decided that all telephone companies must provide, under certain circumstances, customer billing name and address information to all interstate telephone service providers to facilitate their billing needs. In that regard, the FCC specifically requires us to notify customers of this fact. In accordance with FCC rules, your billing name and address information will be provided to all requesting interstate service providers in the following two instances: 1) Your billing name and address will be disclosed, pursuant to Policies and Rules Concerning Local Exchange Carrier Validation and Billing Information for Joint Use Calling Cards, CC Docket no. 91-115, FCC 93-254, adopted May 13, 1993, whenever you use the calling card issued by the Company to pay for services obtained from a telecommunications service provider, and; 2) Your billing name and address will be disclosed, pursuant to Policies and Rules Concerning Local Exchange Carrier Validation and Billing Information for Joint Use Calling Cards, CC Docket no. 91-115, FCC 93-254, adopted May 13, 1993, whenever you accept a third party or collect call to your home or business telephone number.
